Fabrifex Terms of Service

Effective Date: September 9, 2026

These Terms of Service (“Terms”) govern your access to and use of websites, games, software, and other products and services offered under the Fabrifex name, including Aquilae (collectively, the “Services”).

By accessing or using the Services, creating an account, or otherwise indicating your acceptance of these Terms, you agree to be bound by them. If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least 13 years old to use the Services.

Individuals under 13 years of age are not permitted to create an account or use the Services. If Fabrifex learns that an account belongs to a person under 13, the account may be suspended or deleted.

If you are under the age of legal majority where you live, you represent that you have any permission from a parent or legal guardian required by applicable law to use the Services.

2. Accounts

Some Services may require an account.

You agree to provide accurate information when required and to keep your account credentials secure. You are responsible for activity conducted through your account except to the extent caused by circumstances outside your reasonable control.

You may not sell, transfer, impersonate another person through, or improperly access another user’s account.

You should notify Fabrifex if you believe your account has been compromised.

3. Acceptable Use

You may not use the Services to:

Individual Services may establish additional gameplay, community, or acceptable-use rules. Those rules form part of the conditions for using that Service.

4. Games, Fair Play, and Exploits

Fabrifex games may contain competitive, multiplayer, persistent-world, or player-versus-player systems.

Actions permitted by a game’s intended mechanics, including competition, warfare, economic activity, or conflict between players, are not by themselves violations of these Terms.

However, exploiting unintended bugs, vulnerabilities, duplication errors, unauthorized automation, or other technical defects may result in corrective action, including reversal of affected game state, removal of improperly obtained resources or advantages, suspension, or account termination.

Players are encouraged to report suspected bugs and vulnerabilities rather than exploit them.

5. Pre-Release and Experimental Services

Some Fabrifex Services may be identified as alpha, beta, early access, experimental, preview, or otherwise pre-release.

Pre-release Services are under active development. They may contain bugs, incomplete features, balance problems, security issues, performance problems, or other defects.

Features, mechanics, interfaces, content, and technical requirements may change substantially during development. Fabrifex may reset, modify, migrate, or delete game progress, accounts, characters, worlds, or other data when reasonably necessary for development, testing, security, or operation of a pre-release Service.

Fabrifex does not guarantee that pre-release data or progress will be preserved through later releases.

6. User Content

The Services may allow you to submit, create, transmit, or display content, including messages, character or empire names, descriptions, posts, and other material (“User Content”).

You retain ownership of any rights you hold in your User Content.

By submitting User Content through the Services, you grant Fabrifex a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and otherwise use that content to the extent reasonably necessary to provide, operate, secure, moderate, maintain, improve, and develop the Services.

This license does not transfer ownership of your User Content to Fabrifex.

You are responsible for User Content you submit and must have the rights necessary to submit it.

Fabrifex may remove or restrict User Content that violates these Terms, applicable Service rules, or applicable law.

7. Fabrifex Content and Intellectual Property

Except for User Content and content belonging to third parties, the Services and their associated software, game systems, designs, text, graphics, branding, and other materials are owned by or licensed for use by Fabrifex and are protected by applicable intellectual-property laws.

These Terms give you permission to use the Services for their intended purposes. They do not transfer ownership of the Services or their intellectual property to you.

Unless separately permitted by Fabrifex or applicable law, you may not copy, sell, redistribute, or commercially exploit Fabrifex software or content outside the normal use of the Services.

Open-source software provided by Fabrifex is governed by the applicable open-source license rather than conflicting provisions of this section.

8. Service Availability and Changes

Fabrifex may modify, update, suspend, restrict, or discontinue all or part of a Service.

Fabrifex does not guarantee uninterrupted or error-free availability. Services may become unavailable because of maintenance, software defects, infrastructure failures, security incidents, third-party failures, development work, or circumstances outside Fabrifex’s control.

Where reasonably practical, Fabrifex may provide notice of significant planned changes or interruptions, but does not guarantee advance notice in every circumstance.

9. Third-Party Services

Fabrifex Services may interact with or provide links to third-party services, platforms, software, or websites.

Your use of third-party services may be governed by the third party’s own terms and privacy practices. Fabrifex is not responsible for third-party services that it does not operate or control.

10. Payments and Future Paid Features

Some Services are currently provided without charge. Fabrifex may offer optional paid products, features, subscriptions, donations, or other transactions in the future.

Any additional payment, refund, subscription, or purchase terms applicable to a paid offering will be disclosed when that offering is made available.

Fabrifex will not impose a new charge on you merely because a previously free Service changes its business model without first informing you of the applicable charge.

11. Moderation, Suspension, and Termination

Fabrifex may warn, restrict, suspend, or terminate access to the Services when reasonably necessary to enforce these Terms, protect users or the Services, respond to security threats, comply with law, or address serious or repeated misconduct.

The response may depend on the severity and circumstances of the conduct. Fabrifex is not required to use progressively stronger penalties where immediate action is reasonably necessary.

You may stop using the Services at any time.

Account deletion and personal-data requests are handled in accordance with the Fabrifex Privacy Policy and applicable law.

12. Security Research and Vulnerability Reporting

Fabrifex welcomes responsible reports of security vulnerabilities.

You must not use security research as a justification to access, modify, destroy, disclose, or retain another person’s data without authorization; materially disrupt the Services; compromise accounts; or exploit a vulnerability beyond what is reasonably necessary to identify and report it.

Good-faith security reports should be submitted through the contact method designated by Fabrifex.

13. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

Fabrifex does not guarantee that the Services will always be available, secure, error-free, compatible with every device or software configuration, or free from data loss or other defects.

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Fabrifex will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of, or inability to use, the Services.

This includes, where permitted by law, loss of game progress, virtual items, data, opportunities, profits, or goodwill.

Nothing in these Terms limits liability that cannot lawfully be limited or excluded.

15. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, or expenses arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person’s rights.

This provision does not require you to indemnify Fabrifex for Fabrifex’s own unlawful conduct.

16. Governing Law

These Terms and disputes arising from or relating to them or the Services are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Nothing in these Terms deprives you of consumer protections or other rights that cannot lawfully be waived in the jurisdiction where you reside.

17. Changes to These Terms

Fabrifex may update these Terms as the Services develop or as legal, technical, or operational requirements change.

The current version will be made available through the Fabrifex website with an updated effective date.

When a change materially affects users’ rights or obligations, Fabrifex will make reasonable efforts to provide additional notice where appropriate.

Continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by applicable law.

18. Severability

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

19. Entire Agreement

These Terms, the Fabrifex Privacy Policy, and any additional terms or rules expressly applicable to a particular Service constitute the agreement between you and Fabrifex regarding your use of that Service.

If Service-specific terms conflict with these Terms, the Service-specific terms control with respect to that Service.

20. Contact

Questions about these Terms or the Fabrifex Services may be submitted through the contact information published on the Fabrifex website.
